1.1 About the Terms
Welcome to Stylemold (“Stylemold”, “we”, “our”, or “us”). These Terms and Conditions (“Terms”) govern your access to and use of the Stylemold website, including all features, services, tools, content, and functionalities provided on or through the website (collectively, the “Platform” or “Services”).
Stylemold is a personal styling and fashion discovery platform designed to provide Users with:
1. Live, one-on-one styling consultations with professional Stylists
2. Personalized Style Guides containing curated outfit recommendations
3. Shoppable product links that redirect Users to third-party Brand Partners or Dropshipping Sellers
Important Note: Stylemold does not manufacture, stock, or sell products. All product purchases are completed directly between Users and third-party sellers, and Stylemold acts solely as an intermediary platform facilitating discovery, recommendations, and purchase flow.
These Terms apply to all Users, including:
• Individuals accessing the Platform for browsing or consultations
• Users purchasing products via third-party links
• Brand Partners, Stylists, or collaborators engaging with the Platform
• Any future services, features, or functionalities introduced on the Platform
By accessing or using the Platform, you confirm that you have read, understood, and agreed to these Terms, along with the Privacy Policy and any other policies referenced herein.
The purpose of these Terms is to ensure clarity, transparency, and legal enforceability for both Users and Stylemold, covering the obligations, rights, and limitations applicable to the Platform, Stylists, Brand Partners, and Users.
1.2 When are these Terms applicable and binding on the User?
These Terms become applicable and legally binding on any individual or entity at the moment they access, browse, or use any part of the Stylemold website or avail of any services offered through the Platform. Such individuals or entities are collectively referred to as “Users”, which includes, without limitation, browsers, designers, suppliers, purchasers, and contributors of content.
By merely visiting, accessing, or using the Stylemold Platform or Services, the User acknowledges that they have read, understood, and agreed to be bound by these Terms.
1.3 Agreement Effectiveness
This Agreement comes into effect on the date the User first accesses the Stylemold website and/or continues to use the Platform after any updates or modifications to these Terms. Such access or continued use constitutes a legally binding agreement between the User and Stylemold.
2. ACCOUNT REGISTRATION, SUSPENSION AND TERMINATION
2. Account Registration
2.1 Access to Stylemold’s Platform and Services is permitted only to Users who have successfully created a registered account. Users are required to register on the Platform in order to book styling consultations, receive personalised style guides, access shoppable recommendations, or place orders for products.
2.2 User registration on the Platform shall be completed exclusively through a valid mobile number and/or email address. No other mode of registration shall be permitted unless expressly enabled by the Company.
2.3 By registering an account, the User becomes a member of the Platform solely for the purpose of availing the Services offered by Stylemold. Such membership is personal, limited, non-transferable, and non-assignable, and shall not be shared, sold, or sublicensed to any third party.
2.4 The Company does not permit Users to avail the Services without prior registration. Any access to the Platform without registration shall be limited to viewing informational content only and shall not entitle the User to use paid or interactive Services.
2.1 Eligibility to Register
2.1.1 There is no age-based eligibility requirement for a User to register on the Platform.
2.1.2 By creating an account and using the Services, the User represents and warrants that they have the legal capacity to enter into binding arrangements, make payments, and comply with these Terms in accordance with applicable laws.
2.1.3 The Company reserves the right to deny, restrict, suspend, or terminate access to the Platform if it is determined that the User is legally incapable of entering into such arrangements or is using the Platform in violation of applicable laws.
2.2 Registration Information and Communication Consent
2.2.1 At the time of registration, the User shall provide accurate, current, and complete information, including a valid mobile number and/or email address.
2.2.2 By registering on the Platform, the User expressly consents to be contacted by Stylemold through email, phone calls, SMS, instant messaging platforms, or in-app notifications for purposes including but not limited to:
• account-related communications;
• consultation confirmations and reminders;
• service updates;
• transactional communications;
• promotional or marketing communications.
2.2.3 Users may opt out of non-essential promotional communications through the opt-out mechanisms provided within such communications or by contacting Stylemold’s support team.
2.2.4 It is the sole responsibility of the User to ensure that the registered email address and mobile number remain active, accessible, and accurate at all times.
2.2.5 Stylemold shall not be responsible for any failure of communication where such failure arises due to incorrect contact details, network issues, device limitations, service provider restrictions, spam filters, or user-side blocking.
2.2.6 Any communication sent by Stylemold to the registered contact details shall be deemed to have been validly and effectively delivered, irrespective of whether the User actually receives or reads such communication.
2.3 Accuracy and Updating of Information
2.3.1 The User agrees to provide true, accurate, current, and complete information during the registration process.
2.3.2 The User further agrees to promptly update such information to ensure that it remains accurate, current, and complete at all times.
2.3.3 Stylemold shall not be liable for any loss, delay, service disruption, or inconvenience arising from inaccurate, outdated, or incomplete information provided by the User.
2.4 Suspension or Termination of User Account
2.4.1 The Company reserves the right, at its sole discretion and without prior notice, to suspend, restrict, or terminate a User’s account or access to the Platform (in whole or in part) if:
a) any information provided by the User during registration or thereafter is found to be inaccurate, misleading, outdated, or incomplete;
b) the User engages in unlawful, fraudulent, abusive, deceptive, or negligent conduct;
c) the User misbehaves with the stylists or misuses the styling services, including repeated cancellations, abuse of consultation privileges, or misuse of personalised recommendations;
d) the User violates any provision of this Agreement, platform policies, or applicable laws;
e) the User’s actions adversely affect the Platform, its stylists, partners, or other users.
2.4.2 Upon suspension or termination, the User shall remain liable for all obligations, charges, or transactions incurred up to the effective date of such suspension or termination.
2.4.3 Stylemold may cancel or restrict access to any pending or future Services associated with the terminated account.
2.5 Action in Case of Breach or Misuse
2.5.1 Without prejudice to other rights, in the event of suspected fraud, misuse, or material breach of this Agreement, the Company may, at its sole discretion:
• block or disable the User’s account temporarily or permanently;
• withhold or cancel access to Services or benefits;
• impose reasonable penalties proportionate to the breach;
• set off such penalties against any amounts payable to the User, if applicable.
2.5.2 Where such breach gives rise to civil or criminal liability, the Company reserves the right to initiate appropriate legal proceedings in accordance with applicable laws.
2.6 User Responsibilities for Account Security
2.6.1 The User acknowledges that all activities conducted through their registered account shall be deemed to have been undertaken by the User themselves.
2.6.2 The User shall be solely responsible for maintaining the confidentiality of account credentials, including login details, verification codes, and passwords.
2.6.3 The User agrees to:
• take full responsibility for all activities conducted through their account;
• immediately notify the Company of any unauthorised access or security breach;
• ensure proper logout from the account at the end of each session, where applicable.
2.6.4 Stylemold shall not be liable for any loss or damage arising from the User’s failure to safeguard account credentials.
2.7 Ownership of Accounts
2.7.1 The User acknowledges that the creation of an account does not confer any ownership or proprietary rights in the Platform or the account.
2.7.2 All rights, title, and interest in and to the user account shall at all times remain vested solely with Stylemold.
2.7.3 Stylemold reserves the right to modify, restrict, or discontinue user accounts as necessary to maintain platform integrity, compliance, and service quality.
3. PLACING ORDERS AND FINANCIAL TERMS
3 Order Placement on the Platform
3.1 The Platform enables Users to place orders for fashion and lifestyle products recommended during styling consultations or displayed through personalised and curated content on the Platform.
3.11 Stylemold facilitates the placement of such orders between the User and independent third-party suppliers or fulfilment partners and does not itself sell, manufacture, stock, or own any products.
3.12 Upon submission of an order by a User, Stylemold may generate an electronic order acknowledgement and transmit the order details to the relevant supplier for confirmation and fulfilment.
3.13 Any acknowledgement issued by Stylemold shall not be construed as final acceptance of the order. An order shall be deemed confirmed only upon acceptance by the concerned supplier.
3.14 Stylemold may notify the User regarding order status, product availability, unavailability, or pricing changes as communicated by the supplier from time to time.
3.15 Users acknowledge that fulfilment timelines, shipping, and delivery obligations are the sole responsibility of the respective supplier and not Stylemold.
3.16 Users agree to provide accurate, complete, and current purchase, delivery, and account information for all orders placed through the Platform.
Stylemold shall not be liable for delays or failures arising due to incorrect or incomplete information provided by the User.
3.2 Nature of Platform and Commercial Terms
3.2 Stylemold operates as a technology-enabled styling and commerce facilitation platform and acts only as an intermediary between Users and third-party suppliers.
3.21 All commercial and contractual terms relating to a product order, including but not limited to price, discounts, delivery timelines, shipping methods, warranties, exchanges, cancellations, and refunds, are determined solely by the respective supplier.
3.22 Stylemold does not control, influence, determine, or advise upon the commercial terms offered by suppliers and shall not be responsible for supplier performance or contractual compliance.
3.23 Policies relating to returns, exchanges, refunds, cancellations, or penalties may be updated on the Platform from time to time based on supplier practices, operational requirements, or regulatory changes.
3.24 Stylemold reserves the right to modify, restrict, or withdraw platform-level benefits, including payment options or promotional offers, at its sole discretion due to internal or external factors.
3.3 Payments and Payment Processing
3.3 Users acknowledge and agree that Stylemold may act as a limited payment collection facilitator on behalf of third-party suppliers solely for the purpose of enabling transactions on the Platform.
3.31 The payment services provided through the Platform are facilitated via third-party payment processors and do not constitute banking or financial services.
3.32 Stylemold does not act as a trustee or fiduciary in respect of any transaction amount and shall not be liable for any charges imposed by banks, card issuers, or payment service providers.
3.33 In connection with an order, Users may be required to provide personal, billing, transaction, device, and payment-related information either to Stylemold or to the relevant third-party payment processor.
3.34 Where Users are redirected to third-party payment gateways, such transactions shall be governed by the terms and privacy policies of those service providers, and Stylemold shall not be responsible for their data handling practices.
3.4 Taxes and Statutory Charges
3.4 All applicable taxes, duties, and statutory levies relating to a transaction shall be determined, charged, and remitted by the respective supplier in accordance with applicable laws.
3.41 Stylemold shall not be responsible for the accuracy, legality, or compliance of taxes charged by suppliers.
3.42 The underlying transaction remains a bilateral transaction between the User and the supplier, and Stylemold shall not be liable to collect or deposit taxes unless required under applicable law.
3.5 Refunds and Payment Details
3.5 Where applicable, Users may be required to provide valid bank or payment details for processing refunds or reversals arising from cancelled or returned orders.
3.51 Stylemold may impose reasonable restrictions on updating payment or bank details to prevent fraud, misuse, or operational abuse.
3.52 Stylemold reserves the right to limit the frequency or manner of such updates in accordance with platform policies.
3.6 Cash on Delivery and Payment Restrictions
3.6 Stylemold reserves the right to enable, restrict, suspend, or disable cash-on-delivery or other payment methods at its sole discretion.
3.61 Such restrictions may be applied based on factors including product value, supplier limitations, risk assessment, order history, or operational considerations.
3.7 Charges for Styling and Platform Services
3.7 Stylemold provides personal styling consultations, style guidance, and personalised recommendations to Users without charging any separate fee for such styling services, unless expressly stated otherwise on the Platform.
3.71 Users acknowledge that Stylemold does not levy any consultation fee, membership fee, or service charge for accessing stylist-led recommendations, personalised style guides, or curated shopping suggestions.
3.72 Any amounts paid by the User on the Platform are solely towards the purchase of products offered by third-party suppliers and not towards styling or advisory services.
3.73 Stylemold reserves the right to introduce paid services, premium features, or subscription-based offerings in the future, subject to prior disclosure on the Platform.
3.8 Platform Offers and Benefits by Stylemold
3.8 From time to time, Stylemold may conduct marketing, promotional, or engagement campaigns on the Platform, which may include platform-level offers, benefits, or incentives provided directly by Stylemold (“Stylemold Offers”).
3.81 Stylemold Offers shall be governed by specific terms and conditions determined solely by Stylemold and may vary based on factors such as user activity, transaction history, geographic location, time period, or campaign eligibility criteria.
3.82 Stylemold reserves the right to make such offers available for a limited duration and to modify, suspend, discontinue, or withdraw any Stylemold Offer at its sole discretion without prior notice.
3.83 The scope, validity period, eligibility criteria, and applicable products or services under a Stylemold Offer may be changed or amended from time to time.
3.84 Certain Stylemold Offers may be subject to availability, usage limits, or platform-defined conditions and may apply only to specific users, sessions, or transactions.
3.85 Users are responsible for reviewing and complying with the terms and conditions applicable to each Stylemold Offer before availing the same.
3.86 Unless expressly stated, Stylemold Offers shall not be combined with other offers, vouchers, or promotions.
3.87 Stylemold Offers are non-transferable, non-exchangeable for cash, and may only be used in the manner specified on the Platform.
3.9 Supplier Offers on the Platform
3.9 Product-level discounts, price reductions, or promotional benefits displayed on the Platform may be offered directly by third-party suppliers (“Supplier Offers”).
3.91 Supplier Offers are determined, funded, and governed solely by the respective suppliers, and Stylemold does not control or influence such offers.
3.92 The terms of Supplier Offers may vary based on factors including product category, availability, customer segment, time period, or supplier discretion.
3.93 Supplier Offers may be available for limited quantities or limited time periods and shall be subject to product availability at the time of order placement.
3.94 Certain Supplier Offers may apply only to specific products and shall not extend to similar or identical products offered by the same or other suppliers.
3.95 In cases where a product purchased under a Supplier Offer is cancelled or returned in accordance with the applicable return or refund policy, any discount or benefit applied to such product shall stand forfeited, and the User shall be entitled only to the amount actually paid by them.
3.96 Stylemold and/or the supplier shall not be liable for the withdrawal, modification, or non-availability of any Supplier Offer.
3.10 Stylemold Rewards Program
3.10 Stylemold operates a loyalty and rewards initiative known as the Stylemold Rewards Program, under which eligible Users may earn virtual reward points (“Style Coins”) in accordance with the terms stated herein.
3.101 Style Coins may be earned by eligible Users through activities such as purchasing eligible products, engaging with platform features, participating in campaigns, or such other actions as may be notified by Stylemold from time to time.
3.102 The products or activities eligible for earning Style Coins shall be clearly identified on the Platform through labels, indicators, or other means determined by Stylemold.
3.103 The number of Style Coins earned may vary based on product type, transaction value, user engagement level, or other criteria determined by Stylemold at its sole discretion.
3.104 The applicable Style Coins earnable for a particular product or activity shall be disclosed to the User prior to completion of the transaction.
3.105 Style Coins have no cash value, are non-transferable, and may only be redeemed or used in accordance with the terms specified under the Stylemold Rewards Program.
3.106 Stylemold reserves the right to modify, suspend, or discontinue the Stylemold Rewards Program, including the earning or redemption structure, at any time without prior notice.
4. USE OF THE PLATFORM
4.1 Availability and Access to the Platform
4.11 The Company endeavours to make the Stylemold platform accessible to Users on a continuous basis. However, the Company does not guarantee uninterrupted, timely, secure, or error-free access to the Platform at all times.
4.12 Access to the Platform may be temporarily suspended or restricted due to maintenance, system upgrades, technical issues, force majeure events, or reasons beyond the Company’s control.
4.13 The Platform is currently web-based only and does not require downloading or installation of any application. Users are responsible for ensuring stable internet connectivity and compatible devices to access the Platform.
4.14 The Company does not warrant that the Platform will be compatible with all browsers, devices, hardware, or software used by Users.
4.15 The Platform is provided on an “as is” and “as available” basis. The Company expressly disclaims all warranties, whether express or implied, including fitness for a particular purpose or non-infringement.
4.16 Users acknowledge that they are solely responsible for any loss of data, system damage, or other issues arising from accessing or using the Platform.
4.2 Role of the Company
4.21 Stylemold acts solely as a facilitator of styling-related services and interactions between Users and third-party Suppliers, where applicable.
4.22 The Company does not guarantee the performance, quality, delivery, or outcome of any services or products offered by third-party Suppliers on or through the Platform.
4.23 The Company is not a party to any agreement entered into between Users and Suppliers and shall not be responsible for any breach, non-performance, delay, or dispute arising out of such arrangements.
4.24 The Company is not required to mediate, arbitrate, or resolve disputes between Users, Suppliers, or any third party.
4.3 No Ownership or Control Over Products or Services
4.31 The Company does not, at any time, take possession of, hold title to, or claim ownership over any product or service offered by Suppliers on the Platform.
4.32 The Company shall not be liable for unavailability, stock issues, delays, or discontinuation of any products or services offered by third parties.
4.4 User Conduct and Platform Restrictions
4.41 Users shall not use the Platform to host, upload, post, transmit, or share any content that:
4.411 Belongs to another person without lawful authority or consent;
4.412 Is unlawful, harmful, abusive, harassing, defamatory, obscene, pornographic, hateful, misleading, or otherwise objectionable;
4.413 Violates any intellectual property, privacy, publicity, or proprietary rights of any third party;
4.414 Contains false information, impersonates another person, or misrepresents identity or affiliation;
4.415 Promotes illegal activities, gambling, money laundering, or prohibited goods or services;
4.416 Contains malware, viruses, or any code intended to disrupt, damage, or gain unauthorized access to systems or data;
4.417 Threatens public order, national security, or violates any applicable laws or regulations.
4.5 User Obligations
4.51 Users agree that all information provided by them on the Platform shall be accurate, lawful, and up to date.
4.52 Users shall use the Platform solely for personal and lawful purposes and shall not allow third parties to access their accounts.
4.53 Users shall not attempt to access restricted areas of the Platform, interfere with its functioning, or bypass security measures.
4.54 Users shall ensure compliance with all applicable laws, including the Information Technology Act, 2000 and other relevant regulations.
4.6 Intellectual Property and Content Rights
4.61 By submitting any content on the Platform, Users grant the Company a non-exclusive, worldwide, perpetual, royalty-free, and sublicensable right to use such content solely for operating, improving, and providing the services of the Platform.
4.62 The Company shall use User-provided information strictly in accordance with these Terms and applicable laws.
4.7 Enforcement and Suspension
4.71 The Company reserves the right, at its sole discretion, to restrict, suspend, or terminate access to the Platform if a User violates these Terms.
4.72 The Company may take appropriate legal action, including claiming damages, in cases involving misuse, unauthorized access, or security breaches.
5. FAIR USAGE POLICY
5.1 Purpose
5.1.1 Stylemold is committed to providing a smooth and enjoyable experience on its Platform.
5.1.2 To ensure fair use of the Platform, Stylemold monitors user activity, including order history, returns, cancellations, and other usage patterns.
5.2 Monitoring and Evaluation
5.2.1 Stylemold may track metrics such as return rate, cancellation rate, claim rate, or other usage indicators to detect unusual or abusive behaviour.
5.2.2 Examples of potential abuse include:
• Excessive returns or repeated refusal to accept deliveries.
• Fraudulent, suspicious, or misleading activity.
• Activities that violate the Terms of Use or other Platform policies.
5.3 Enforcement and Consequences
5.3.1 If a User is found to be engaging in misuse or unfair practices, Stylemold reserves the right to take corrective actions, including but not limited to:
• Limiting or blocking access to certain Services.
• Temporarily or permanently disabling COD (Cash on Delivery) options.
• Restricting refund claims or cancelling pending orders.
• Charging a service fee, where applicable.
5.3.2 Stylemold may also suspend or block users whose behaviour negatively affects the experience of other users or the integrity of the Platform.
5.4 Rewards and Benefits
5.4.1 Users who maintain consistent, responsible, and valid activity on the Platform may be eligible for benefits, points, or other rewards at the discretion of Stylemold or its partners.
5.4.2 Such rewards or benefits will be granted based on user activity patterns and may vary according to volume of usage, frequency of transactions, or other criteria determined by Stylemold.
6. ACCURACY AND COMPLETENESS OF INFORMATION ON PLATFORM
6.1 Accuracy of Information
6.1.1 Stylemold makes reasonable efforts to ensure that the content on its Platform is accurate and up-to-date. However, all information, including product listings, pricing, offers, and other details, is provided for general guidance only and should not be relied upon as the sole basis for decisions.
6.1.2 Most product information is provided by Suppliers. Stylemold performs basic checks to maintain Platform hygiene but does not control or verify the accuracy of Supplier-provided content.
6.1.3 Historical information may be displayed for reference. Stylemold may modify or update content at any time but is not obligated to do so. Users are responsible for verifying information before making decisions.
6.1.4 Occasional errors, omissions, or inaccuracies may occur in product details, pricing, promotions, shipping, or availability. Stylemold reserves the right to correct such errors without prior notice.
6.2 Supplier-Provided Information
6.2.1 Product details, specifications, and descriptions are primarily provided by Suppliers, who are solely responsible for their accuracy. Suppliers must not exaggerate or misrepresent products.
6.2.2 Stylemold may monitor or remove content that, in its sole discretion, violates the law or these Terms, but does not assume responsibility for Supplier content.
6.2.3 Stylemold does not endorse or guarantee any product sold on the Platform. Users acknowledge that Stylemold is not liable for any inaccuracies, incomplete information, or outdated content provided by Suppliers or other Users.
6.3 Disclaimer
6.3.1 All information on the Platform is provided “as is” without warranty of any kind, express or implied, including but not limited to accuracy, completeness, timeliness, merchantability, or fitness for a particular purpose.
6.3.2 Users are responsible for exercising independent judgment and verifying all product-related information before making purchases or other decisions on the Platform.
7. LISTING AND SELLING
7.1 Compliance with Laws
7.1.1 Suppliers are responsible for ensuring that the products they list on the Stylemold Platform comply with all applicable laws relevant to the product category and e-commerce. Stylemold acts solely as a facilitator of online transactions and is not liable for any legal non-compliance by Suppliers.
7.1.2 Suppliers agree to indemnify Stylemold against any losses, claims, or penalties arising from violations of applicable laws related to their products.
7.2 Listing Products on the Platform
7.2.1 Suppliers may list products on Stylemold in accordance with this Agreement and any specific arrangements made with the Company.
7.2.2 By listing a product, Suppliers represent and warrant that:
• They have the legal right to sell or offer the product;
• The product and its listing do not infringe any third-party intellectual property, trade secrets, publicity, or privacy rights;
• They will not use third-party images or content without proper authorization.
7.2.3 Stylemold is not responsible for any breach of third-party rights or any legal obligations arising from the Supplier’s listings.
7.3 E-Commerce Model Only
7.3.1 Stylemold facilitates e-commerce transactions only. Products are sold directly by Suppliers through the Platform; Stylemold does not hold inventory or take ownership of any product.
7.3.2 Any disputes, returns, or claims regarding products are solely between the Supplier and the buyer. Stylemold’s role is limited to providing the online platform for the transaction.
8. USER INFORMATION AND THIRD-PARTY TOOLS / LINKS
8.1 Collection and Use of User Information
8.1.1 Stylemold collects certain information from Users when they access or use the Platform. This information may include both personal and non-personal data.
8.1.2 Such information is collected and processed solely for legitimate business purposes, including but not limited to user registration, account management, order processing, payments, customer support, platform analytics, and improvement of services.
8.1.3 The collection, storage, use, and protection of User information are governed by Stylemold’s Privacy Policy, which Users are advised to review carefully to understand how their data is handled.
8.2 Use of Third-Party Tools
8.2.1 The Platform may, from time to time, provide access to tools, services, or features developed or operated by third parties. Stylemold does not control, monitor, or manage such third-party tools.
8.2.2 Access to and use of any third-party tools is provided on an “as is” and “as available” basis, without any warranties, guarantees, or endorsements by Stylemold.
8.2.3 Users acknowledge that their use of such tools is entirely at their own discretion and risk, and Stylemold shall not be liable for any issues, losses, or damages arising from the use of third-party tools.
8.2.4 Users are responsible for reviewing and agreeing to the terms, conditions, and policies of the respective third-party service providers before using such tools.
8.3 Third-Party Links and External Resources
8.3.1 The Platform may contain links to third-party websites, services, or resources that are not owned, operated, or controlled by Stylemold.
8.3.2 Stylemold does not verify, endorse, or guarantee the accuracy, security, or reliability of any third-party content, products, or services accessible through such links.
8.3.3 Stylemold shall not be responsible or liable for any harm, loss, or damage resulting from the User’s interaction with or reliance on any third-party website, content, or service.
8.3.4 Users are advised to independently review the terms, privacy policies, and practices of third-party platforms before engaging in any transactions or sharing any information.
9. INTELLECTUAL PROPERTY (IP) AND IP INFRINGEMENT
9.1 Use of Platform Content and Stylemold Intellectual Property
9.1.1 All content available on the Platform, including but not limited to the Stylemold name, logo, trademarks, interface design, text, images, graphics, and software, is owned by or licensed to Stylemold and is protected under applicable intellectual property laws.
9.1.2 Users are not permitted to copy, reproduce, modify, distribute, display, publish, or use any Platform content or Stylemold intellectual property for any commercial or business purpose without prior written permission from Stylemold.
9.1.3 Users shall not use any Stylemold trademarks, branding, logos, or similar identifiers while conducting business with third parties or on external platforms unless expressly authorised by Stylemold in writing.
9.1.4 Users must not alter, separate, or misuse any material made available on the Platform, including images, videos, graphics, or text, whether in digital or printed form.
9.1.5 The Platform may include technical and security measures to protect its content and software. Users agree not to attempt to bypass, disable, tamper with, or interfere with any such safeguards or usage restrictions implemented by Stylemold.
9.2 Intellectual Property Rights of Users and Suppliers
9.2.1 Any intellectual property, including trademarks, brand names, logos, or content, uploaded or used by Users or Suppliers in relation to their listings remains the property of the respective owner.
9.2.2 Stylemold does not claim ownership over such intellectual property and shall not be responsible for verifying the ownership or legality of any content or products listed on the Platform by Users or Suppliers.
9.3 Handling of Intellectual Property Infringement
9.3.1 Stylemold reserves the right, at its sole discretion, to remove, restrict, or disable access to any listing, content, or material that it reasonably believes may infringe intellectual property rights, violate applicable laws, or expose Stylemold to legal risk.
9.3.2 Stylemold may suspend or terminate User or Supplier accounts if it deems such action necessary in connection with alleged or repeated intellectual property violations.
9.3.3 Users acknowledge that Stylemold is not an adjudicating authority and does not determine the validity of intellectual property claims between third parties. Any action taken by Stylemold, including delisting or account restriction, is solely for protecting its platform and does not amount to an endorsement or rejection of any infringement claim.
9.3.4 Stylemold shall not be liable for any losses, damages, or consequences suffered by Users or Suppliers due to actions taken in relation to intellectual property concerns, including suspension, termination, or delisting of products.
9.3.5 Users are encouraged to report any suspected intellectual property infringement on the Platform. Stylemold may cooperate with lawful investigations or rights holders as required.
10. DISCLAIMER AND LIMITATION OF LIABILITY
10.1 General Disclaimer
10.1.1 The Platform and Services are provided on an “as is” and “as available” basis. Stylemold makes no representations or warranties of any kind, express or implied, regarding the operation of the Platform or the information, content, or services made available through it, except as expressly stated in this Agreement.
10.1.2 Stylemold shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, loss of data, business interruption, or system failure, arising out of or related to the use of, or inability to use, the Platform or Services, even if Stylemold has been advised of the possibility of such damages.
10.1.3 Users access and use the Platform at their own risk. Stylemold shall not be responsible for any damage to User devices, systems, or data resulting from accessing, downloading, or using any content available on the Platform.
10.1.4 Any information, guidance, or communication provided by Stylemold through the Platform or otherwise shall not constitute a warranty unless expressly stated in writing.
10.2 Product-Related Disclaimer
10.2.1 Suppliers are solely responsible for the accuracy, legality, quality, and description of the products listed by them on the Platform.
10.2.2 Stylemold does not manufacture, store, inspect, or control the products sold through the Platform and shall not be liable for any loss, damage, injury, or claim arising from the use, misuse, or purchase of such products.
10.2.3 Users are solely responsible for ensuring that their purchase and use of products is lawful and appropriate.
10.3 Advertisements and Promotional Content
10.3.1 Any product images, videos, banners, or promotional content displayed on external media or third-party platforms are for illustrative purposes only and may differ from the actual product.
10.3.2 Prices, discounts, offers, or promotional details shown in advertisements are indicative in nature and may vary based on availability, seller policies, location, time, or User-specific factors.
10.3.3 Stylemold does not guarantee the accuracy or continuity of any promotional offer and reserves the right to modify, suspend, or discontinue any advertisement or promotion without prior notice.
10.4 Force Majeure
10.4.1 Stylemold shall not be liable for any failure, delay, or disruption in performance caused by events beyond its reasonable control, including but not limited to natural disasters, governmental actions, strikes, network failures, pandemics, or technical breakdowns.
10.4.2 During such events, Stylemold may temporarily suspend, restrict, or modify access to the Platform or Services until normal operations are restored.
10.5 User Indemnity
10.5.1 Users agree to indemnify, defend, and hold harmless Stylemold, its affiliates, officers, directors, employees, agents, and partners from and against any claims, losses, damages, liabilities, penalties, costs, or expenses (including reasonable legal fees) arising out of or related to:
• breach of this Agreement by the User;
• misuse of the Platform or Services;
• violation of applicable laws or regulations; or
• infringement of any third-party rights, including intellectual property rights.

11.1.3 Stylemold shall make reasonable efforts to review and respond to communications within a reasonable timeframe, in accordance with applicable laws.

11.3 How Will the Company Communicate with Users?
11.3.1 Stylemold communicates with Users only through email and WhatsApp using the contact details provided by the User at the time of registration or during use of the Platform.
11.3.2 Any notices, updates, confirmations, or important communications shall be considered valid if sent to the User’s registered email address or WhatsApp number.
11.3.3 Users are responsible for ensuring that their contact details remain accurate and up to date on the Platform. Stylemold shall not be responsible for any failure to receive communications due to incorrect or outdated contact information.
11.4 Fraud Awareness and Account Safety
11.4.1 Users are advised to remain cautious of fraudulent calls, messages, or communications from individuals falsely claiming to represent Stylemold.
11.4.2 Stylemold representatives will never:
• Ask for passwords, OTPs, PINs, or payment credentials
• Demand money for rewards, offers, or services
• Request account access over calls or unofficial channels
11.4.3 If any such request is received, Users should immediately refrain from sharing information and contact Stylemold only through its official email address (info@stylemold.com) or verified WhatsApp communication.
11.5 Confidentiality of Communications
11.5.1 Communications between Users and Stylemold via email or WhatsApp are treated as confidential.
11.5.2 Stylemold may retain or review communications for internal purposes such as service improvement, compliance, training, or dispute resolution, in accordance with applicable laws.
11.5.3 Users agree not to misuse, misrepresent, or publicly disclose such communications in a manner that is unlawful or misleading.
12. MISCELLANEOUS PROVISIONS
12.1 Governing Law and Jurisdiction
This Agreement shall be governed by and construed in accordance with the laws of India. Any dispute, claim, or legal proceeding arising out of or in connection with this Agreement, the Platform, or the Services provided by Stylemold shall be subject to the exclusive jurisdiction of the competent courts located in Agra, Uttar Pradesh, India.
12.2 Assignment
Stylemold reserves the right to assign, transfer, or delegate its rights, obligations, or duties under this Agreement, in whole or in part, to any third party, including its affiliates, successors, or business partners, without requiring prior notice or consent from the User.
12.3 No Waiver
Any failure or delay by Stylemold in exercising or enforcing any right or provision under this Agreement shall not be deemed to be a waiver of such right or provision, nor shall it affect Stylemold’s ability to enforce the same at a later stage.
12.4 Platform Access and Territorial Use
The Platform is operated and managed from India. Stylemold makes no representation that the content, services, or features available on the Platform are suitable or accessible in jurisdictions outside India. Users accessing the Platform from outside India do so at their own risk and are solely responsible for compliance with applicable local laws.
12.5 Modification of Services
Stylemold reserves the right to introduce new features, modify existing services, suspend, discontinue, or remove any part of the Platform or Services at its sole discretion, with or without prior notice. Stylemold may also introduce charges for services that were previously offered free of cost.
